RESOLUTION NO. 2023-03

A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO ISSUE A
QUITCLAIM DEED TO MARY CATHERINE KNOX ET VIR, DON A. KNOX
FOR A PORTION OF THE ALLEYWAY ABANDONED BY THE CITY
MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS RESOLUTION.

WHEREAS, the City of Athens officially closed and abandoned an alley between Astrid
Street and Elk Street as described in Ordinance No. 426 adopted May 19, 1970; and,

WHEREAS, Mary Catherine Knox Et Vir, Don A. Knox has asked the City of Athens to
quitclaim the property along the rear lot lines of Lots 40, 41, 42, 43, 44, and 45 of the F.M.
Wofford Subdivision to Mary Catherine Knox Et Vir, Don A. Knox.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Athens, Tennessee, as
follows:

That the recitals above are true and accurate and form a part of this Resolution; and

That meeting in regular session this 17th day of January 2023, that the Mayor and City
Manager be authorized, directed, and empowered to sell the hereinafter described property to
Mary Catherine Knox Et Vir, Don A. Knox for and in consideration of One Dollar ($1.00) and other
good and valuable consideration, the receipt and legal sufficiency of all of which are hereby
acknowledged, all of Grantor’s right, title, and interest in and to the following described real
estate, together with all improvements, fixtures, easements, hereditaments, and appurtenances
associated with such real property (the “Parcels”) which are more particularly described as
follows, to wit:

Situated in the City of Athens, First (1st) Civil District of McMinn County, Tennessee, and
lying along the rear lot lines of Lots 40, 41, 42, 43, 44, and 45 of the F.M. Wofford Subdivision as
recorded in Deed Book 31, page 452, and being the northern portion of the original Alleyway as
abandoned by City of Athens Ordinance 426 on 05/19/1970, and being particularly described as
follows:

Beginning at the Southeast corner of Lot 45; thence to the center of the abandoned
alleyway for a distance of 7.5 feet; thence with the centerline of the abandoned alleyway for 150
feet plus or minus to the extension of the line between Lot 39 and 40; thence North to the
Southwest corner of Lot 40 for 7.5 feet; thence with the Southern boundary line of Lots 40, 41,
42, 43, 44, and 45 to the point of beginning.

The City of Athens, Tennessee authorizes the execution of a Quitclaim Deed of the

property along the rear lot lines of Lots 40, 41, 42, 43, 44, and 45 of the F.M. Wofford Subdivision
to Mary Catherine Knox Et Vir, Don A. Knox.
