Describing a specific agreement between Kimley-Horn and Associates, Inc. (the “Consultant” or “KH"), and
River Stone Construction (‘the Client” or “River Stone’) in accordance with the terms of the Master
Agreement for Continuing Professional Services dated February 12, 2025, which is incorporated herein by

reference.

Project Name: Fox Den Subdivision Offsite Roadway !mprovements — City of Athens, TN

KH Project Manager: Adam Driver

PROJECT UNDERSTANDING

Based on the information provided by the comments received from the Tennessee Department of
Transportation (TDOT) and City of Athens on the land disturbance permit (LDP), we understand that offsite
roadway impravements are required to address access concerns at the intersection of Congress Parkway
at Lee Drive based on the Traffic Impact Study (TIS). There is currently a full access median opening at the
subject intersection that is not aligned with Lee Drive. The current recommended roadway improvements

at the intersection are as follows:

* Congress Parkway — Widen into the existing median to provide a northbound left turn lane with 100
LF of storage and a 100 LF bay taper. Modify the existing median on the north side of the

intersection to better align with Lee Drive.
e Lee Drive — No improvements are currently required for Lee Drive

Comments received from TDOT/City of Athens indicate a desire to shift the median opening to line up with
Lee Drive and investigate the need for a left turn lane

SCOPE OF SERVICES
Kimley-Horn will provide the services specifically set forth below

Task 1— TDOT Encroachment Documents
Kimley-Horn will prepare one set of documents far median modifications far the scope of work described in

the Project Understanding that is within the state route right-of-way.

Task 2 ~ Encroachment Permit - TDOT

The TDOT plans and supporting documentation will be submitted to TDOT for their review towards
obtaining an Encroachment Permit. Landscape and Hardscape Plans are required for work within the right-
of-way. Design variance requests are not included in the base scope of services. Lane and sidewalk closure
permits and utility permits to be administered by the Contractor
