Chris,

We received a written request, that Mitchell wrote about below, last year for the city to give this lot back to the
landowner on the corner of Tellico and Hammerhill. I unfortunately dropped the ball and forgot all about
reaching out to you to find out if what we proposing was the legal way to proceed. We were going to remove
the building and abandoned the unbuildable lot to them though a resolution and let them pay any associated cost
for the survey. Just like we would do when we abandon alleys.

This land cannot be built on and can only benefit the adjacent landowners or the city. And the city has no use
for this portion of Parcel 048P C 039.00, but we will retain the remaining acreage (shown as lot 5 on the plat)
across the street for regional detention and stormwater use. We have an adopted policy about transferring city
owned land, but it does not address this unique situation and wanted to get advice as to how we may get this
acreage back onto the tax rolls again.

It was quit claimed deeded to the city per Habitat for Humanity (tax card attached). I have also attached the plat
and a drawing showing the way we suggest giving this back to the adjacent landowners (Yellow 0.95-acre
section goes to lot on corner-Purple 0.95-acre section to the apartment complex). Unlike an alley that would
require a public hearing per TCA Section 54-10-202 because of historical access issues that may exist, this land
would not require that because it was never part of any roadway system. Please let me know the legal way to
proceed with this request before I reach out to the apartment landowner to see if they want a portion or not. If
the landowner of the apartment doesn’t wish to take part, then we propose to grant it all to the lot on the corner
of Hammerhill and Tellico.
