AN ORDINANCE AMENDING TITLE 14 ENTITLED ‘ ZONING AND LAND USE 
CONTROL’ BY AMENDING CHAPTER 5 OF THE ATHENS MUNICIPAL CODE TO 
AMEND THE STORMWATER MANAGEMENT ORDINANCE. 
BE IT ORDAINED BY THE CITY OF ATHENS, TENNESSEE, AS FOLLOWS: 
SECTION 1. That Title 14 entitled “Zoning and Land Use Control” be amended by 
deleting Chapter 5 in its entirety and substituting a new Chapter 5 as follows:

14-501 General pr
ovisions.
(1) It is the purpose of this chapter to:
(a) Protect, maintain, and enhance the environment of the City of Athens and the
public health, safety and the general welfare of the citizens of the City, by
controlling discharges of pollutants to the City’s stormwater system and to
maintain and improve the quality of the receiving waters into which the
stormwater outfalls flow, including, without limitation, lakes, rivers, streams,
ponds, wetlands, and groundwater of the City;
(b) Enable the City of Athens to comply with the National Pollution Discharge
Elimination System permit (NPDES) and applicable regulations, 40 CFR § 122 as
applicable for stormwater discharges;
(c) Allow the City of Athens to exercise the powers granted in Tennessee Code
Annotated    § 68-221-1105, which provides that, among other powers cities have
with respect to stormwater facilities, is the power by ordinance or resolution to:
(i.) Exercise general regulation over the planning, location, construction, and 
operation and maintenance of stormwater facilities in the City, whether or 
not owned and operated by the City;
