Ki mley » Horn November 5, 2025, Page 5 Task 3 — Final Plan Revisions and Land Development Permitting Following client review of the 90% plan set, Kimley-Horn will make final plan revisions. Upon approval of final revisions, Kimley-Horn prepare and submit plan applications to the City of Athens, Athens Utility Board (AUB), Tennessee Department, of Environment and Conservation (TDEC), and Tennessee Department of Transportation (TDOT) for their review towards obtaining a Land Development Permit (LDP). The labor budget provided is based on our recent experience and responding to two (2) rounds of review comments per department. All fees associated with obtaining a permit (impact, permit, inspection, etc.) are the responsibility of the Client and/or Owner. The approved, permitted set of plans will become the Civil documents issued for construction. No additional building permits, demo permits, wall permits, phased LDP permits, or phasing of any other permits are included in this task. KH has no control over the actions of jurisdictional agencies and is not a party to agreements between the client and others. Accordingly, professional opinions as to the status of permits and entitlements herein and professional opinions as to the probability and timeframe for approvals are made on the basis of professional experience and available data. The Consultant does not guarantee that the outcome of permits and entitlements will not vary from its opinions. Because its opinions are based upon limited site investigation and scope of services, the Consultant does not guarantee that all issues affecting the site have been investigated. Task 4 — Opinion of Probable Construction Cost Kimley-Horn will provide an opinion of the probable construction cost to accompany the preliminary design plans. The opinion of probable construction cost will be based on actual bid prices for recent projects which involved similar equipment and construction, to the extent that such information is available. Any opinions rendered as to costs, expenses, or revenue, including but not limited to opinion as to the costs of construction and materials, shall be made based on the Consultant's experience and represent its judgement as an experienced and qualified professional, familiar with the industry. The Consultant cannot and does not guarantee that proposals, bids, actual costs, or revenues will not vary from its opinions. Task 5 — Bid Phase Services Based on the Final Plans prepared under Task 3, Kimley-Horn will prepare a bid package in accordance with City of Athens standards, including technical specifications for those items that are not covered by City of Athens specifications. The bid package will contain the Request for Proposals, the contract documents, bid forms, disadvantaged business enterprise (DBE) requirements (if applicable), specifications, and required special provisions. The bid package will be submitted to the City of Athens procurement office for approval and authorization for the City to proceed with bidding the project. Kimley-Horn will assist the City with drafting the advertisement for bids and conduct one pre-bid meeting with potential bidders. Kimley-Horn staff will assist the city in responding to questions that arise during the bidding process and issue statements of clarification or bid addenda as appropriate. Kimley-Horn will be present for the bid opening and meet with City of Athens staff following the bid opening to assist with bid review. In addition, Kimley-Horn will tabulate the bids received and evaluate the compliance of the bids with the bidding documents.
