A RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY FROM 
MAYFIELD DAIRY FOR THE PURPOSE OF CONSTRUCTING A STORMWATER 
FACILITY USING ARP GRANT FUNDS 
WHEREAS, the City of Athens has received a grant from the Tennessee Department of 
Environment and Conservation through the American Rescue Plan (ARP) in the amount of 
$2,371,902.77, requiring a local match of $355,785.42, for a total project budget of $2,727,688.19 
for stormwater infrastructure projects; and 
WHEREAS, one of the primary projects to be undertaken with these funds is the 
construction of a stormwater facility near the Wetlands Trail and Ingleside Park to improve water 
quality, reduce flooding and streambank erosion, and create future educational and recreational 
opportunities; and 
WHEREAS, the parcel of land needed for the project (Parcel 057H D 001.00, 
approximately 5.12 acres) is currently owned by DEAN DAIRY FLUID LLC  d/b/a Mayfield 
Dairy and lies entirely within the flood zone and largely within the floodway, rendering its future 
private use severely limited; and 
WHEREAS, the City has obtained a certified appraisal determining the value of the parcel 
to be between $99,000 and $135,000, and based on this, has determined to proceed with the 
purchase at a cost of $135,000, which falls within the anticipated range; and 
WHEREAS, the McMinn County Industrial Development Board (IDB) will facilitate the 
transaction by acquiring the parcel from Mayfield Dairy through a negotiated exchange of 
engineering and site improvements, and will in turn convey the parcel to the City of Athens for the 
sum of $135,000; and 
WHEREAS, the City, IDB, and Mayfield Dairy have agreed in principle to collaborate on 
future development of an educational trail on the parcel focusing on stormwater management, 
agriculture, and dairy operations, and Mayfield may participate in sponsorship or naming if 
additional funding becomes available; 
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 
CITY OF ATHENS, TENNESSEE: 
1. That the City of Athens is hereby authorized to purchase Parcel 057H D 001.00 from the 
McMinn County Industrial Development Board for the sum of $135,000 using ARP grant 
funds. 
 
2. That said property is to be used for the construction of stormwater improvements and related 
amenities, as designed by Gresham Smith & Partners based on collaboration with Mayfield 
Dairy. 
 
3. That the City further authorizes collaboration with the IDB and Mayfield Dairy in seeking 
future funding for development of an educational trail on the property, as referenced in the 
master plan. 
 
BE IT FURTHER RESOLVED that the Mayor and City Manager are authorized to take 
all necessary steps to finalize the purchase, including executing any agreements, deeds, or 
documents required to complete the transaction. 
 
BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon 
its adoption, the public welfare requiring it.
