RESOLUTION NO. 2022-27 
 
A RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION WITH THE STATE 
OF TENNESSEE DEPARTMENT OF ENVIRONMENT & CONSERVATION (TDEC)  
FOR ARP STORMWATER PROJECT FUNDING 
 
 WHEREAS, Tennessee’s Water Infrastructure Investment Plan (WIIP) describes how the 
State of Tennessee plans to invest the state’s American Rescue Plan (ARP) fiscal recovery funds 
in water infrastructure projects; and, 
 
 WHEREAS, The state’s Financial Stimulus Accountability Group (FSAG) designated  $1.35 
billion for the Tennessee Department of Environment and Conservation (TDEC) to administer for 
this purpose, $1 billion of which is being dedicated to non-competitive, formula-based grants for 
eligible drinking water, wastewater, or stormwater projects; and, 
 
 WHEREAS, The Athens Public Works Department maintains the stormwater  system and 
has taken considerable strides to expand, upgrade, and repair whe never able; however, Athens 
does not have a dedicated stormwater utility fund for these operations  and ARP funds are an 
ideal mechanism to dedicate to studying, planning, and constructing improvements to the City’s 
MS4 network; and, 
 
 WHEREAS, Athens has been allocated a maximum non-competitive monetary balance of 
$2,371,902.77 for eligible activities  which requires a maximum co -funding level of 15%, or 
$355,785.22 if it is fully utilized; and, 
 
 WHEREAS, Non-competitive funds are allocated but are not obligated and Agencies must 
apply to TDEC detailing proposed activities and projects it intends to pursue with the funds for in 
order to have them obligated to the City for use; and, 
 
WHEREAS, The Public Works Department intends to pursue utilization of the full 
allocation to perform a stormwater utility study, implement an asset management system for the 
stormwater network, solicit engineering study and design for targeted and system -wide 
stormwater improvements, and repair and/or construct new green stormwater infrastructure as 
part of those improvements; and,  
 
WHEREAS, The Public Works Department is requesting City Council authorize submittal 
of an application to request allocation of ARP funds for the aforementioned activities  as part of 
the City’s ongoing mission to achieve water quality improvement goals outlined in the City 
Stormwater Management Plan, which is an integral part of its MS4 Phase II permit. 
 
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Athens, Tennessee, as 
follows: 
 
That the recitals above are true and accurate and form a part of this Resolution; and
