RESOLUTION NO. 2022-20 A RESOLUTION ADOPTING A PLAN OF SERVICES FOR THE ANNEXATION OF THE COUNTY ROAD 129 AREA PROPERTY BY THE CITY OF ATHENS, TENNESSEE WHEREAS, the City of Athens is considering the annexation of property; and WHEREAS, Tennessee Code Annotated (TCA) 6-51-102 as amended requires that a “Plan of Service” be adopted by the governing body of a municipality prior to the adoption of a resolution annexing an area; and WHEREAS, in accordance with T CA 6 -51-102 the Athens Municipal -Regional Planning Commission has recommended approval of the Plan of Services to the Council of the City of Athens, Tennessee; and WHEREAS, a public hearing was held pursuant to TCA section 6 -51-102, and notice thereof was published in the Daily Post-Athenian; and WHEREAS, the City of Athens is considering annexation of property off of County Road 129 as detailed in Annexation Resolution # 2022-21. NOW, THEREFORE, BE IT R ESOLVED by the Council of the City of Athens, Tennessee, as follows: SECTION 1: Below is the “Plan of Service” for the proposed annexation of County Road 129 (aka Layman Road inside City) the remaining approximate 32 acres of Tax Map 055, Parcel 104.00, and part of a larger parcel identified as McMinn County Tax Map 055, Parcel 104.00 that contains 45.0 total acres to be recommended to City Council for adoption. A. Police 1. Patrolling, radio responses to calls, and other routine police services using present personnel and equipment will be provided o n the ef fective date o f annexation. 2. Traffic signals, traffic signs, street markings, and other traffic control devices will be installed as the need is established by appropriate study and traffic standards. B. Fire 1. Fire protection by the present personnel and equ ipment of the City of Athens, within the limitations of available water, will be provided to the area on the effective date of annexation. 2. Fire hydrants for the County Road 129 Annexation Area that are required to be installed by the landowner when the parcel is developed. Any future additional fire hydrants will be made available per the policies and requirements of the C ity 33
