Minutes July 5, 2022 Athens Regional Municipal Planning Commission meeting  
5. Annexation Study and Plan of service recommendation for County Road 129 part of 
Parcel 055 104.00. 
 
Mr. Casteel said this is approximately thirty-five acres of a remaining lot that is part in the 
city. He showed the Commission a notarized request from the landowners. It is across 
from McMinn County High School; he pointed out Lark Street and Lark Lane. The only 
access to this property currently is off County Road 129. It has a fifty-foot flag stem there’s 
thirteen acres in the city and there are thirty -five outside the city . The main question is 
whether they want to annex the road . He is not recommending they do that  right now 
because it is contiguous to the city. If they annex the road, it creates a donut hole. There 
is no reason to do that. They will still be able to provide services down that roadway and 
that is what he is recommending.  
 
Mr. Casteel said under the plan of services they address police services, fire services. 
Based on the census, there is a possibility of 737 people could be in there when they 
finally get it developed. They are going to do a duplex, apartment rentals is what he heard. 
They do not have to do that, as they have asked for R-2 zoning and they can do anything 
the R-2 zone allows, which they will bring it to the Commission once it is annexed, they 
will have to have it zoned and once it is zoned, it will be done. No added fire, any fire 
service they need fire hydrants will come  under the development. They will have to put 
those in, and it is no cost to the city. AUB has come back and told what their policy is for 
water and sewer. That will be handled at the time when they do the site plan, and they 
will have to be the ones who e xtend the sewer at their cost. It is the same with natural 
gas services. Street lighting policy will be the same it has always been, but there will 
probably be service lights. The city may provide one on the right-of-way where you come 
into the entrance. That will be the only light the city would have to pay for. Wastewater 
service will also be handled the same way as everybody else. He does not know if they 
will be using dumpsters or have individual pickup; they will have to work that out with 
public works. That is all covered under the development fees. There are no streets so no 
cost to the city. They will do planning and zoning and subdivision regulations for free other 
than what the fees already are. They can use the city schools starting in 2022. They can 
use the city parks. He said if they want, they can recommend to city council that they can 
annex this property with no cost to the taxpayers.  
 
Chairperson Hamilton said that is assuming they do not annex the street.  
 
Mr. Casteel said that is what he is recommending, and he thinks it is what public works is 
recommending as well that they do not take the county road portion at this time.  
 
Chairperson Hamilton asked if the property owner requested the street.  
 
Mr. Casteel said no.
